A Philadelphia tenant has filed what is believed to be the first lawsuit under the city's 2025 antitrust law prohibiting corporate landlords from using algorithmic rent-setting software to coordinate rental prices. The lawsuit, filed in the Philadelphia Court of Common Pleas, alleges that Willow Bridge Property Company violated the ordinance by using pricing software from RealPage to set rents at its Vue 32 and Rittenhouse Row apartment communities, which together contain 244 units. The ordinance allows tenants to sue landlords directly and seek triple damages or $2,000 per violation. The case follows a recent settlement between RealPage and the U.S. Department of Justice requiring the company to change how its software uses competitors' rental data but imposing no admission of wrongdoing or financial penalties.
