NOTE: Upper Darby has started charging a U&O fee effective Jan. 1, 2026. A cancellation fee has been added as well. Property transfer inspections that are canceled with less than 24 hours’ notice, or where access is not granted or the applicant fails to appear, will be assessed a $100 cancellation, failure-to-show, or failure-to-grant-access fee.

Open House Directional Signs:
  • Signs may be a maximum of 4 sq. ft.,
  • Placed on private property on day of open house.
  • May not be displayed more than two hours before the event and must be removed within two hours of the event ending.
For Sale/Sold Signs:
  • Signs may be a maximum of 6 sq. ft.,
  • One sign per street frontage,
  • Not within public right of way or within line of site for vehicles.
  • Should be removed by the day of settlement.
  • PLEASE NOTE: Upper Darby Township prohibits the use of For Sale directional signs.
Solicitation Rules:

A permit is required for any individual who peddles or solicits upon and of the streets or sidewalks or from house to house within the Township.

On December 15, 2021 the Upper Darby Borough Council passed an increase to the RTT which will increase and shift the tax to 0.75 township and 0.75 school district. PLEASE NOTE: Settlements that occur on or after January 1, 2022 will be subject to 1.5 percent transfer tax for Upper Darby Township (0.75 percent) and Upper Darby School District (0.75 percent) plus the 1 percent to the state for a total of 2.5 percent for real estate transfer tax.

(In 2021 and prior, 1 percent of the real estate transfer tax went to the school district and 1 percent went to the state.)

Property Maintenance Requirements:

Property Maintenance is a division of the Administrative Services Department which instills the quality of housing in all neighborhoods throughout the township. This is accomplished by using a select group of code enforcement officers who interact on a daily basis with the public’s concerns and requests.

This is done both on a proactive and reactive basis with each and every house in the township, which consists of approximately 28,000 homes and 150 miles of streets. Each code enforcement officer conducts on a daily basis inspections on properties within the boundaries of the township for the purpose of determining and enforcing whether property maintenance violations exist.
