Municipalities must give at least 12 months for homeowners to address issues cited in a use and occupancy (U&O) inspection. If a municipality is requiring one of your clients to complete repairs in a shorter amount of time, let us know.

The 12-month minimum timeline is required by the state's Municipal Code and Ordinance Compliance Act (MCOCA), thanks to amendments made in 2016 by Act 133 that strengthened protections for property owners.

Unfortunately, we still hear about towns and boroughs giving shorter timelines for U&O repairs — like 30 or 60 days. We're currently working on the issue in two Montgomery County boroughs, and we're ready to respond if our shareholder members encounter it elsewhere.
